Standard Competition Terms
1. Qualifying Persons
Titan Prizes Ltd run competitions – we are a prize draw company with regular competitions that result in the allocation of prizes in accordance with these terms and conditions on our website www.titanprizes.com Each and all such competitions being referred to herein respectively as the ‘Competition’ or ‘Competitions’.
The competitions are open to all persons aged 18 (UK) and over and the legal age in their country of residence.
Titan Prizes Ltd reserves the right to cancel a customer’s account at any time, if they feel the customer is misusing the services. Attempts to break these terms and conditions, such as registering more than one account to one person/household to get around the maximum entry rules will result in automatic disqualification from all competitions and all such accounts being permanently blocked from entering any future competitions. Further such attempts to register new accounts will also be blocked and subsequent entries will be void.
2. Legal Undertaking
By entering a Competition the entrant (‘Entrant’, ‘you’, ‘your(s)’) will be deemed to have legal capacity to do so, you will have read and understood these terms and conditions and you will be bound by them and by any other requirements set out in any related promotional material.
Competitions are governed by English Law and any matters relating to the Competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction.
In the event that you participate in a Competition online via the Website, and by accepting these terms and conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our competitions. Titan Prizes Ltd will not be held responsible for any Entrant entering any of our Competitions unlawfully.
If in any doubt you should immediately leave the Website and check with the relevant authorities in your country.
3. Competition Entry
Competitions may be entered via the www.titanprizes.com, may run multiple competitions and may be operated at the same time and each competition will have a different prize.
Availability and pricing of competitions is at the discretion of the Promoter and will be specified at the point of sale on the Website. There is no requirement to pay to enter any competition, as each competition has a free entry route available – see rule below for details of how to enter for free. The availability of a free entry route to enter each competition means that the competition does not fall within the definition of a lottery under the Gambling Act 2005 and can be operated legally in Great Britain without any need for a licence.
In order to enter a Competition, you will need to register an account with us. You can register an account online. To register an account online you will be asked to provide an email address.
When playing a Competition online via the Website, you must follow the on- screen instructions to: (a) select the Competition you wish to enter and when you are ready to purchase your ticket(s) to the Competition (‘Tickets’), provide your contact and payment details. You will need to check your details carefully and tick the declaration, confirming you have read and understood the Competition terms and conditions; (b) once you have purchased your Tickets, register to play the relevant Competition and when your payment has cleared we will then contact you by email to confirm your entry into the Competition. Please note that when entering online and/or by post you will not be deemed entered into the Competition until we confirm your entry which can be confirmed in your account when you login (and any such entry referred to herein as an ‘Entry’ or ‘Entries’).
For postal entries, the Entrant will be entered into the draw in the same way as any paid entry. Sending a postal entry does not guarantee entry to a draw. Postal entries will not be counted if a prize sells out before the processing time that day. It is advised that you give your entry plenty of time to arrive, we cannot be held responsible for Royal Mail’s delivery times or loss/late delivery of postal entries by Royal Mail.
Free entries must be posted on a post card and sent to: Titan Prizes Ltd, Old Carnegie Library, 361 Ormskirk Road, Wigan, WN5 9DQ and must arrive by the Competition closing date. The Entrant must specify which Competition they wish to enter. Each entry must be on individual post cards and must contain your date of birth to proof you’re old enough to enter. A random number/s will be allocated to each free entry by the Promoter and you will be notified of the number(s) by email.
Titan Prizes Ltd reserves the right to refuse or disqualify any incomplete entries if it has reasonable grounds for believing that an entrant has contravened any of these terms and conditions, including the same person/household sending in entries against more than one account.
To the extent permitted by applicable law, all entries become our property and will not be returned.
The Entrant can enter the competitions up to the amount of 5 entries for each competition. However, this can be reduced or increased at Titan Prizes Ltd discretion if stated on the individual competition pages, for example, a low odds competition we may limit to 1-2 entries per person.
The competition closes when the timer shown against the competition reaches zero and/or the last available entry is taken. No more entries after this point will be accepted.
All entrants must create an account prior to entering, and supply an email address and contact telephone number to proceed in the competition.
4. Competition Draws
Titan Prizes Ltd will use a state of the art random competition machine that will generate a random number combination using between 2 and 5 individually numbered balls to create a combination between 99 and 99999 that will determine the winner of each competition. Every draw will be live streamed on our Facebook, Twitter and YouTube page, as well as via our website and app.
Due to the nature of the winning judgement there will only be one 1st prize winner per competition, unless otherwise stipulated in the description. Some competitions may have multiple prizes. This will be stipulated in the individual competition.
Titan Prizes Ltd will attempt to contact winner(s) using the contact information provided at the time of Entry (or as subsequently updated) and held securely in our database. It is the Entrant’s sole responsibility to check and update these details. If for any reason they are recorded incorrectly, Titan Prizes Ltd will not be held responsible. Entrants must carefully check their contact details have been recorded and maintained correctly.
If for any reason Titan Prizes Ltd is unable to contact a winner within 14 days (which may be extended at the sole discretion of Titan Prizes Ltd) of the end of a Competition or the winner fails to confirm acceptance of the prize or the winner is disqualified as a result of contravening any of these terms and conditions, the winner will forfeit the prize and the prize will remain in the possession and ownership of Titan Prizes Ltd
All Entrants are automatically entered onto Titan Prizes Ltd database for the purpose of conveying information as to the status of their Competition, as well as any future Promotions or Competitions offered by Titan Prizes Ltd.
All competitions are guaranteed and no extensions to the advertised draw date or rollovers will be applied.
5. Competition Prizes
Titan Prizes Ltd prizes are determined, selected by the directors of the company. All prizes are picked and purchased by Titan Prizes Ltd. Details of each prize can be found on the website on the competition’s pages. Titan Prizes Ltd take no responsibility for the prize awarded after it has been delivered. Once the winner receives the prize Titan Prizes Ltd does not insure the prize.
No insurance comes with the prizes and Titan Prizes Ltd cannot be held responsible for the prize once handed over to the winner.
Delivery to the winner is free to any mainland UK address. Titan Prizes Ltd has a right to charge the winner delivery fees if they want the prize delivering anywhere other than mainland UK.
All entrant expenses are the sole responsibility of the winners.
All prizes are subject to the terms and conditions of the prize provider, manufacturer or supplier.
Each Prize must be accepted as awarded and is non-transferable or convertible to other substitutes and cannot be used in conjunction with any other vouchers, offers or discounts, including without limitation any vouchers or offers of Titan Prizes Ltd or other prize suppliers.
6. Winners
The prize winner (upon first time of winning) will be required to show proof of identification prior to delivery of the prize. This is to ensure all winners are UK residents who are over the age of 18. Any failure or refusal to meet this obligation may result in the winner being disqualified and Titan Prizes Ltd retaining the prize.
All winners will also be asked to provide photographs and/or pose for photographs and videos, which may be used in future marketing and public relations by Titan Prizes Ltd in connection with the Competition and in identifying them as a winner of a Competition.
Titan Prizes Ltd will respect the right of an individual prize winner that prefers not to provide a photo or video for our website, social media and email marketing purposes.
Following receipt and verification of the details requested above by Titan Prizes Ltd, the Winners will be contacted in order to make arrangements for delivery of the prize.
7. Winners’ Personal Data
Acceptance of the prize by the Winner will mean they are required to have their photo and video taken by Titan Prizes Ltd for promotional purposes (Public Relations and Marketing), both immediately after their win and in the future for use in accordance with rule 6 unless prohibited by law.
By entering a Competition, you agree to the use of your name and/or photograph or other likeness to be used for marketing purposes as required by Titan Prizes Ltd if you are declared a winner.
Limits of Liability. Titan Prizes Ltd makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of Titan Prizes Ltd, Titan Prizes Ltd shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by Titan Prizes Ltd, or its servants or agents, in connection with the arrangement for supply, or the supply itself, of any goods by any person to the prize winner(s) and, where applicable, to any family/persons accompanying the winner(s), or in connection with any of the Competitions promoted by Titan Prizes Ltd.
8. Electronic Communications
No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes.
Titan Prizes Ltd shall use its best endeavours to award the prize for a competition to the correct entrant. If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, Titan Prizes Ltd reserves the right to reclaim the Competition prize and award it to the correct Entrant, at its sole discretion and without admission of liability. In the event that Titan Prizes Ltd closes a Competition early, the Winner will be selected from all valid and eligible entries received by Titan Prizes Ltd prior to the date of closure, except that Titan Prizes Ltd reserves the right, at its sole discretion, to close a Competition early without selecting a winner.
In the event that a Competition is closed without selecting a winner, Titan Prizes Ltd will give all entrants a refund to the value of the ticket purchased. Titan Prizes Ltd also reserves the right at its sole discretion to extend the closing date of any Competition. Titan Prizes Ltd shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due.
Titan Prizes Ltd shall use its best endeavours to ensure that the software and website(s) used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers. For the avoidance of doubt, only the ticket recorded in our systems, however displayed or calculated, shall be entered into the relevant Competition and Titan Prizes Ltd shall not be held liable for any competition entries that occur as a result of malfunctioning software or other event.
9. Data Protection Notice
Any personal data that you supply to Titan Prizes Ltd or authorise Titan Prizes Ltd to obtain from a third party, for example, a credit card company, will be used by Titan Prizes Ltd to administer the Competition and fulfil prizes where applicable. In order to process, record and use your personal data Titan Prizes Ltd may disclose it to (i) any credit card company whose name you give; (ii) any person to whom Titan Prizes Ltd proposes to transfer any of Titan Prizes Ltd rights and/or responsibilities under any agreement Titan Prizes Ltd may have with you; (iii) any person to whom Titan Prizes Ltd proposes to transfer its business or any part of it; (iv) comply with any legal or regulatory requirement of Titan Prizes Ltd in any country; and (v) prevent, detect or prosecute fraud and other crime. In order to process, use, record and disclose your personal data Titan Prizes Ltd may need to transfer such information outside the United Kingdom, in which event Titan Prizes Ltd is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.
These terms and conditions constitute the entire agreement between you and the Promoter regarding the subject matter of these terms conditions and supersede and replace any other prior and/or contemporaneous agreements, and/or terms and conditions applicable to the subject matter of these terms and conditions.
A person who is not a party to these terms and conditions has no rights under the Contracts (Rights of Third Parties) Act 1999 (as amended or re-enacted from time to time, and any subordinate legislation made under that act) or otherwise to enforce any provision of these terms and conditions.
10. Sponsorship and Endorsement
Our competitions are not sponsored, endorsed or administered by Apple, Google, Facebook, Twitter or Instagram. Apple, Google, Facebook, Twitter and Instagram are not liable for anything relating to our competitions.
11. Force Majeure
Titan Prizes Ltd shall not be deemed to be in default of any provision hereof or be liable for any delay, failure in performance, or interruption of service resulting directly or indirectly from acts of God, civil or military authority, civil disturbance, war, terrorism, strikes, fires, other catastrophes, power or telecommunications failure or any other cause beyond its reasonable control.
12. Severability
If any provision of these Terms is deemed to be illegal or unenforceable by a court of competent jurisdiction, the enforceability or effectiveness of the remainder of these Terms will not be affected, and these Terms will be enforceable without reference to the unenforceable provision.
13. Governing Law
These Terms will be governed by and interpreted in accordance with the internal laws of England and you submit to the non-exclusive jurisdiction of the state and national courts located in England for the resolution of any disputes that may arise.
14. Refunds
Titan Prizes Ltd does not hold a refund policy and therefore will not refund any money taken.
